Terms & Conditions

These Terms & Conditions (the "Terms," and together with any End User License Agreement, the "Agreement") govern your use of the mobile applications and related services (the "App") provided by OutThinking Electronics Pvt. Ltd. ("we", "us", "our"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial purposes, in accordance with the Apple Media Services Terms and the standard Apple Licensed Application End User License Agreement (EULA). Where these Terms and Apple's standard EULA conflict, the more protective terms for you as a consumer apply.

2. Auto-Renewable Subscriptions

Some features may require a paid, auto-renewable subscription purchased through the Apple App Store. The following applies to all subscriptions:

• The subscription price and billing period (e.g., weekly, monthly, or yearly) are shown clearly in the App before you confirm your purchase.
• Payment is charged to your Apple ID account upon confirmation of purchase.
• Your subscription automatically renews for the same period at the same price unless you turn off auto-renew at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours prior to the end of the current period.
• You can manage or cancel your subscription at any time in your device's Settings → Apple ID → Subscriptions (App Store account settings). Deleting the App does not cancel a subscription.
• If a free trial is offered, any unused portion of the trial period is forfeited when you purchase a subscription, where applicable.

3. Refunds

Because all purchases are processed by Apple, refunds are handled by Apple in accordance with the Apple Media Services Terms and applicable law. We are generally unable to issue refunds directly for App Store purchases. To request a refund, use Apple's Report a Problem page or contact Apple Support. Statutory refund and cancellation rights that apply in your jurisdiction are not affected by this section.

4. Acceptable Use

You agree not to: (a) use the App for any unlawful purpose or in violation of any applicable law; (b) upload or process content you do not have the right to use, including images of other people without their consent; (c) reverse engineer, decompile, or attempt to extract source code except as permitted by law; (d) interfere with or disrupt the App or its servers; or (e) use the App to create unlawful, harmful, infringing, or deceptive content.

5. User Content

You retain ownership of any photos, images, or other content you provide to the App. Such content is processed solely to deliver the feature you request and, as described in our Privacy Policy, is not stored on our servers. You are solely responsible for the content you provide and for ensuring you have the rights and consents necessary to use it.

6. Intellectual Property

The App, including its software, design, text, graphics, and trademarks, is owned by OutThinking Electronics Pvt. Ltd. or its licensors and is protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.

7. Disclaimers

The App is provided on an "as is" and "as available" basis, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that results will meet your expectations.

8. Limitation of Liability

To the maximum extent permitted by law, OutThinking Electronics Pvt. Ltd. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App or subscription in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Maintenance & Support; Apple

You acknowledge that Apple has no obligation to furnish any maintenance or support services for the App, and that we (not Apple) are solely responsible for the App, its content, maintenance, support, and any product warranties and claims, to the extent required by law. Apple and its subsidiaries are third-party beneficiaries of this Agreement and, upon your acceptance, have the right to enforce it against you. You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, as required by the App Store.

10. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

11. Governing Law

These Terms are governed by the laws of India, without regard to conflict-of-law principles, and you agree to the exclusive jurisdiction of the courts located in Bengaluru, Karnataka, India, except where applicable consumer-protection law grants you the right to bring proceedings in your place of residence.

12. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date above and, where appropriate, provide notice within the App. Continued use of the App after changes become effective constitutes acceptance of the updated Terms.
